Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Reef Bulldog mobile application, website at reefbulldog.com, and related services (collectively, the "Service") operated by Reef Bulldog ("we," "us," or "our").

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. By using the Service, you represent that you meet these requirements.

2. Account Registration

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the security of your account credentials.
• You are responsible for all activity that occurs under your account.
• You must notify us immediately at support@reefbulldog.com if you suspect unauthorized access to your account.
• We reserve the right to suspend or terminate accounts that violate these Terms.

3. Subscription Plans and Payment

3.1 Plans

The Service offers multiple subscription tiers: Free, Pro, and Ultimate. Each tier provides different features and usage limits as described on our pricing page. We reserve the right to modify plan features and pricing with reasonable notice.

3.2 Billing

• Paid subscriptions are billed on a recurring monthly basis.
• Payment is due at the beginning of each billing cycle.
• All fees are quoted in U.S. dollars and are non-refundable except as required by applicable law or as expressly stated in these Terms.

3.3 Free Trials

We may offer free trial periods for paid plans. At the end of a trial, your subscription will automatically convert to a paid plan unless you cancel before the trial ends.

3.4 Cancellation

You may cancel your subscription at any time through your account settings. Upon cancellation, your paid features will remain active until the end of the current billing period. After that, your account will revert to the Free tier.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
• Attempt to gain unauthorized access to any part of the Service, other accounts, or connected systems.
• Interfere with or disrupt the integrity or performance of the Service.
• Upload malicious code, viruses, or any other harmful content.
• Use the Service to send spam, phishing messages, or unsolicited communications.
• Reverse engineer, decompile, or disassemble any part of the Service.
• Scrape, crawl, or use automated means to access the Service without our written permission.
• Use the Service in any way that could harm, disable, or impair the Service or interfere with other users' enjoyment.
• Impersonate any person or entity, or falsely state or misrepresent your affiliation with any person or entity.

5. Your Content

5.1 Ownership

You retain all ownership rights to the content you submit to the Service, including tank data, photos, observations, reports, and any other materials ("Your Content"). We do not claim ownership of Your Content.

5.2 License to Us

By submitting Your Content to the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, store, process, and display Your Content solely for the purpose of providing and improving the Service. This license terminates when you delete Your Content or your account.

5.3 Responsibility

You are solely responsible for Your Content. You represent that you have all necessary rights to submit Your Content and that it does not violate any third-party rights or applicable laws.

6. AI-Powered Features

• Certain features of the Service use artificial intelligence and machine learning to provide recommendations, analysis, and insights about your aquarium ("AI Features").
• AI Features are provided for informational purposes only and should not be considered a substitute for professional advice from a qualified aquarist, veterinarian, or marine biologist.
• No Guarantees: AI-generated recommendations may be inaccurate or incomplete. We do not guarantee the accuracy, reliability, or suitability of any AI-generated content.
• Your Responsibility: You are solely responsible for any decisions you make based on AI-generated recommendations. We are not liable for any harm to your aquarium, livestock, or equipment resulting from the use of AI Features.
• To provide AI Features, your tank data may be processed by third-party AI service providers as described in our Privacy Policy.

7. Service Pro Features

If you use Service Pro features for your aquarium service business:

• You are responsible for obtaining any necessary consents from your clients before entering their information into the Service.
• You are responsible for the accuracy of client data, visit records, and field reports.
• The Service is a tool to assist your business operations — it does not create any employment, agency, or partnership relationship between Reef Bulldog and you, your employees, or your clients.
• GPS check-in/check-out data is collected only when you explicitly initiate it and is used solely for visit verification.

8. Intellectual Property

The Service, including its design, code, branding, logos, text, graphics, and all other materials (excluding Your Content), is owned by Reef Bulldog and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our written permission.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Service will be uninterrupted, timely, secure, or error-free.
• The results obtained from using the Service (including AI-generated recommendations) will be accurate or reliable.
• Any defects in the Service will be corrected.

AQUARIUM DISCLAIMER: The Service provides general information and recommendations about reef aquarium keeping. It is not a substitute for professional advice. We are not responsible for the health, well-being, or survival of any aquatic livestock. You assume all risk associated with the care and maintenance of your aquarium and its inhabitants.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL REEFOS, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of or damage to aquatic livestock, corals, or equipment
• Loss of data or profits
• Business interruption
• Any other intangible losses

ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total aggregate liability for all claims arising out of or relating to these Terms or the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless Reef Bulldog and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Your Content

12. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination:

• Your right to use the Service ceases immediately.
• We may delete your account and data after a reasonable retention period (currently 30 days), unless earlier deletion is requested or retention is required by law.
• Provisions that by their nature should survive termination will survive, including Sections 5, 8, 9, 10, 11, and 14.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. For material changes, we may also notify you via email or in-app notification. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.

14. Governing Law and Disputes

These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in the State of Texas. You agree to waive any right to a jury trial or to participate in a class action.

15. General Provisions

• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Reef Bulldog regarding the Service.
• Severability: If any provision of these Terms is held to be unenforceable, the remaining provisions will continue in full force and effect.
• Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
• Assignment: You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights without restriction.
• Force Majeure: We shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including natural disasters, war, terrorism, pandemics, government actions, or internet/infrastructure failures.
